NOTICE IS HEREBY GIVEN that the undersigned Trustee will on the 21st day of August, 2015 at the hour of 10:00 a.m., at the 2nd Floor entry plaza outside the Pierce County Courthouse located at 930 Tacoma Avenue South in the City of Tacoma, State of Washington, sell at public auction to the highest bidder, payable at time of sale, the following described real properties, situate in University Place, Pierce County, Washington, to-wit: LOT 1, PIERCE COUNTY SHORT PLAT NUMBER 9608230208, ACCORDING TO THE PLAT THEREOF RECORDED AUGUST 23, 1996, RECORDS OF PIERCE COUNTY AUDITOR. The real property is commonly known as: 8824 19th Street West, University Place, Washington (the "Property"). The Property is subject to that certain Deed of Trust dated October 18, 2013 recorded October 18, 2013 under Auditor's File No. 201310180614, records of Pierce County, Washington, from JR SAMPSON LLC, a Delaware limited liability company, (doing business in Washington State as JR Sampson Company, a Washington corporation registered under UBI 603077596) as Grantor, to WFG NATIONAL TITLE COMPANY, as Trustee, to secure an obligation in favor of the CATHERINE M. BORDEAUX, a single person, as Beneficiary. WFG NATIONAL TITLE COMPANY is deemed to have resigned as Trustee and the law firm of Gordon Thomas Honeywell LLP was appointed as Trustee as evidenced by the Appointment of Successor Trustee dated March 16, 2015 recorded March 20, 2015 under Auditor's File No. 201503200058, records of Pierce County, Washington. II. No action commenced by the Beneficiary of the Deed of Trust is now pending to seek satisfaction of the obligation in any Court by reason of the Borrower's or Grantor's default on the obligations secured by the Deed of Trust. III. The defaults for which this foreclosure is made are as follows: Failure to pay the balloon payments due on May 1, 2014 and August 1, 2014 together with accrued interest, late penalties and other amounts due under the terms of the deed of trust as more specifically set forth below. Failure to pay when due the following amounts which are now in arrears and/or other defaults: a. Principal unpaid as of May 15, 2015 ^$61,215.97 b. The sum now owing on the obligation secured by the Deed of Trust is: Principal $61,215.97, together with interest and penalties as provided in the note or other instrument secured, and such other costs and fees as are due under the note or other instrument secured and as are provided by statute. V. The above described real property will be sold to satisfy the expense of sale and the obligation secured by the Deed of Trust as provided by statute. The sale will be made without warranty, express or implied, regarding title, possession or encumbrances on August 21, 2015. The default(s) referred to in Paragraph III must be cured by August 10, 2015 (11 days before the sale date) to cause a discontinuance of the sale. The sale will be discontinued and terminated if at any time on or before August 10, 2015 (11 days before the sale date) the default(s) as set forth in Paragraph III are cured and the Trustee's fees and costs are paid. A written Notice of Default was transmitted by the Trustee to the Borrower and Grantor at the following addresses: JR SAMPSON 4040 ORCHARD STREET, STE 208 FIRCREST, WA 98466 by both first class and certified mail on March 20, 2015, proof of which is in the possession of the Trustee; and the written Notice of Default was posted in a conspicuous place on the real property described in Paragraph I above, and the trustee has possession of proof of such service or posting. VII. The Trustee whose name and address are set forth below will provide in writing to anyone requesting it, a statement of all costs and fees due at any time prior to the sale. VIII. The effect of the sale will be to deprive the Grantor and all those who hold by, through or under the Grantor of all their interest in the above-described property. IX. Anyone having any objection to the sale on any grounds whatsoever will be afforded an opportunity to be heard as to those objections if they bring a lawsuit to restrain the sale pursuant to RCW 61.24.130.
