NO. 92-3-03542-1 SUMMONS BY PUBLICATION (SMPB) SUPERIOR COURT OF WASHINGTON COUNTY OF PIERCE In re the marriage of: MADELYN J. BARRY Petitioner, and HOWARD D. BARRY ,JR. Respondent. The State of Washington to the said RESPONDENT: HOWARD D. BARRY , JR You are hereby summoned to appear within sixty days after the date of the first publication of this summons, to wit, within sixty days after the 19th day of February, 2013, and defend the above entitled action in the above entitled court and answer whether the court should grant Petitioner's request to: (1) Enter a Qualified Domestic Relations Order dividing the retirement of Respondent and Order the Washington Meat Industry Pension Trust to pay Petitioner 50% of the retired pay directly to Petitioner as and when it is paid to Respondent; AND (2) Require Respondent to disclose and provide proof thereof of all the dates and amounts of all retirement payments he has received prior to entry of the order requested above. If Respondent fails to do so within 30 days of the entry of the order, Petitioner requests a judicial subpoena to the Washington Meat Industry Pension Trust; (3) Enter judgment with interest against Respondent in favor of Petitioner for her 50% share of all payments previously received by Respondent. The amount owed to Petitioner is to be determined, at a later date, after proof of all payments are received by either Respondent or the Washington Meat Industry Pension Trust; AND (4) Order payment of attorney's fees, other professional fees, and costs. You must respond to Petitioner's motion by serving a copy of your written response upon the undersigned attorney at the address below stated and by filing the original with the clerk of the court. If you do not serve your written response within sixty (60) days after the date of the first publication of this summons (60 days after the 19th day of February, 2013, the court may enter an order of default against you; and the court may, without further notice to you, enter a order and approve or provide for other relief requested in this summons.
