The State of Washington to the said Defendants, Fremont Investment & Loan, its successors and assigns:

You are hereby summoned to appear within sixty days after the date of the first publication of this summons, to wit, within sixty days after the 24th day of June 2025, and defend the above-entitled action in the above-entitled Court, and answer the Complaint of the Plaintiff Harbaksh S. Athwal and Melanie K. Athwal, and Athwal Properties, LLC, and serve a copy of your Answer upon the undersigned Attorney for Plaintiffs Terrence Clayton Posey, at his office below stated; and in case of your failure so to do, a judgment will be rendered against you according to the demand of the Complaint, which has been filed with the Clerk of said Court. Summary of Action: Plaintiffs purchased real property in Pierce County, Washington and received a Trustee’s Deed to that property recorded in Pierce County Auditor’s office on March 2, 2006 under Auditor’s File Number 200603020025. Plaintiffs paid off an encumbering Deed of Trust filed under Auditor’s File Number 200410291149 in 2006. However, the Beneficiary and the Trustee did not reconvey the Deed of Trust prior to filing bankruptcy.

Freemont Investment & Loan failed to cause the Trustee to uphold RCW 61.24.110 where it states “The trustee of record shall reconvey all or any part of the property encumbered by the deed of trust to the person entitled thereto …. upon satisfaction of the obligation secured ….”.
