NOTICE IS HEREBY GIVEN that the undersigned Trustee will on October 16, 2015, at 10A.M., on the 2nd floor entry plaza of the Superior Court, 930 Tacoma Avenue South, Tacoma, Washington 98402, sell at public auction to the highest bidder, payable at the time of sale by cash or certified check, the property located at 12809 228th Ave. East, Bonney Lake, WA 98391, situated in the County of Pierce, State of Washington, to-wit: LOT 129 OF PLAT OF PRAIRIE RIDGE NO. 2, according to Plat recorded in Book 34 of Plats at Page(s) 6 to 9, inclusive, in Pierce County, Washington. It is covenanted and agree that said real property includes as an improvement thereto and thereon that certain 1967, 40ES/15 BUDGR Mobile Home, VIN#94945; as part thereof: It shall not be severed nor removed therefrom. Subject to Paragraphs 6-9 of preliminary report from First American Title Co. which is subject to that certain Deed of Trust dated March 1, 2012, recorded under Auditor's File No. 201203090453, and that certain Deed of Trust dated March 9, 2012 under Auditor's File No. 201203090454 records of Pierce County, Washington, from JAMES L. WASHBURN, as Grantor, to secure an obligation in favor of JAMES S. ANDERSON, Beneficiary. II. No action commenced by the Beneficiary of the Deed of Trust is now pending to seek satisfaction of the obligation in any Court by reason of the Borrower's/ Grantor's default on the obligation secured by the Deed of Trust. III. DELINQUENT TAXES: Parcel No. 4061003100 (mobile home): 2012 taxes $187.13, 2013 taxes $211.61, 2014 taxes $234.28, 2015 taxes $216.76, TOTAL thru 9/ 9/15 $849.68. Parcel No. 699520122290 (real property): 2012 taxes $1,124.48, 2013 taxes $1002.80, 2014 taxes $901.03, 2015 taxes $742.49, Total thru 9/9/ 15: $3,770.80. TOTAL TAXES: $4,620.48. CHARGES, COSTS, FEES, ETC.: Postage $15.00, Posting/Service $140.00, Publishing: $306.68, Attorney's Fees: $2,500.00, TOTAL: $2,961.68. TOTAL ARREARS $32,424.28. IV. The sum owing on the obligation secured by the Deed of Trust is $23,880.00, together with interest as provided in the Notes or other instrument secured from the 1st day of March, 2012, and such other costs and fees as are due under the notes or other instrument secured, and as are provided by statute. V. The above-described real property will be sold to satisfy the expenses of sale and the obligation secured by said Deeds of Trust as provided by statute. The sale will be made without warranty, express or implied, regarding title, possession, or encumbrances on October 16, 2015. The defaults referred to in Par. III must be cured and the Trustee's fees and costs paid by October 5, 2015, to cause a discontinuance of the sale. The sale may be terminated any time after October 5, 2015, and before the sale by the Borrower, Grantor, any Guarantor or holder of any recorded junior lien or encumbrance by paying the entire principal and interest secured by the Deed of Trust, plus costs, fees, and advances, if any, made pursuant to the terms of the obligation and/or Deed of Trust, and curing all other defaults. VI. A written Notice of Default was transmitted by Trustee to Borrower and Grantor at the following address: James L. Washburn, 12809 228th Ave. East, Bonney Lake, WA 98391, by both first class and certified mail on April 7, 2015, proof of which is in the possession of the Trustee; and the Borrower and Grantor were personally served on April 8, 2015, with said written Notice of Default or the written notice of default was posted in a conspicuous place on the real property described in Par. I above, and the Trustee has proof of such service or posting. VII. The Trustee whose name and address is set forth below will provide in writing to anyone requesting it, a statement of all costs and fees due at any time prior to the sale. VIII. The effect of the sale will be to deprive the Grantor and all those who hold by, through or under Grantor of all their interest in the above-described property. IX. Anyone having any objection to the sale on any grounds whatsoever will be afforded an opportunity to be heard as to those objections if they bring a lawsuit to restrain the sale pursuant to RCW 61.24.130 before October 16th, 2015. Failure to bring such a lawsuit may result in a waiver of any proper grounds for invalidating the Trustee's sale. X. NOTICE TO OCCUPANTS OR TENANTS: The purchaser at the trustee's sale is entitled to possession of the property on the 20th day following the sale, as against the grantor under the Deed of Trust (the owner) and anyone having an interest junior to the Deed of Trust, including occupants who are not tenants. After the 20th day following the sale the purchaser has the right to evict occupants who are not tenants by summary proceedings under the unlawful detainer action, Chapter 59.12 RCW.
