NOTICE IS HEREBY GIVEN that the undersigned Trustee will on February 19, 2016, at 10:00 o'clock A.M., at the Outside of the 2nd floor entry plaza of the County-City Building, 930 Tacoma Avenue South, Tacoma, WA 98402, sell at public auction to the highest and best bidder, payable at the time of sale, the following described real property, tax identification number is 983000-007-1 & 983000-007-2, situated in the County of Pierce, State of Washington, to-wit, which is legally described on the attached Exhibit A (hereafter the "Property"), which is subject to that certain Deed of Trust dated September 8, 2008, and recorded on September 9, 2008, in Pierce County, Washington, under Auditor's File No. 200809090487, from M & D Corporation, a Washington Corporation, Grantor; to Chicago Title Insurance Company as Trustee; to secure an obligation in favor of Unibank, a Washington state chartered bank, as Beneficiary. II. No action commenced by the Beneficiary of the Deed of Trust is now pending to seek satisfaction of the obligation in any Court by reason of the Borrower's or Grantor's default on the obligation secured by the Deed of Trust. III. The default(s) for which this foreclosure is made is/are as follows: a. Failure of Borrower to pay all Obligations due under the Note and Change in Terms Agreements on or before July 30, 2015 which was the maturity date of the Note; b. Failure to pay real estate taxes when due on the real property subject to the Deed of Trust. $9,337.58 is past due as of October 16, 2015 on tax parcel 983000-007-1, and $2,423.00 is past due as of October 16, 2015 on tax parcel 983000-007-2. IV. The sum owing on the obligation secured by the Deed of Trust is as follows: an unpaid principal balance in the amount of $1,101,986.35; and unpaid accrued interest in the amount of $52,832.64 as of November 17, 2015, as provided in the note or other instrument secured from September 8, 2008; and such other costs and fees as are due under the note or other instrument secured, and as are provided by statute. V. The above described real property will be sold to satisfy the expense of sale and the obligations secured by the Deed of Trust as provided by statute. The sale will be made without warranty, express or implied, regarding title, possession, or encumbrances on February 19, 2016.
