This Declaration is in reference to your interest under the contract in which Dan Pikron and Gloria Pikron, husband and wife are Seller/Vendor and Walter J. Gooler is Purchaser/Vendee dated October 27, 2004, and recorded November 17, 2004, under Pierce County Auditor's File No. 200411171014, for the sale and purchase of real property legally described as: Parcel A: Lot 1, Pierce County Short Plat No. 77-349, according to the Plat thereof recorded June 7, 1977 in Volume 16 of Short Plats at Page 92, in Pierce County, Washington. Parcel B: A non-exclusive easement for ingress and egress created by instrument recorded under Recording No. 2712715, in Pierce County, Washington; Except any portion within said Lot 1. Parcel C: A non-exclusive easement for Ingress and Egress as delineated on Pierce County Short Plat No. 77-349, according to the Plat thereof recorded June 7, 1977 in Volume 16 of Short Plats at Page 92, in Pierce County, Washington, Except any portion within said Lot 1. Includes Mobile Home: TPO #53063, Year 1978, Make Gibralter, Size 60×24, VIN No. 94118. Tax Parcel No.: 0318348017 and 4163020010. On October 1, 2015 a Notice of Intent to Declare a Forfeiture was served in compliance with the statute cited above. Certain defaults were alleged and remain uncured despite a statutory grace period of ninety (90) days. This forfeiture was conducted in compliance with the said statute in all material respects and the applicable provisions of the contract. The defaults having not been cured the vendor hereby: Declares a Forfeiture of the Contract and a Termination and Cancellation of all the Purchaser's Right, Title, and Interest in the above-described real property and of all persons claiming an interest in the property, the Contract, or a portion of either through the Purchaser or which is otherwise subordinate to the Sellers interest. All persons whose rights in the property are terminated and who are presently in possession of any portion of the property including improvements, timber, and unharvested crops are required to surrender possession to the seller not later than ten (10) days after recording of this declaration namely the 25th day of January, 2016. All payments previously made will be retained as liquidated damages. You may be held liable for the costs and attorney fees incurred by the contract vendor for any legal proceeding necessitated by your failure to abide by the requirements of forfeiture under the statute. The purchaser and any person claiming any interest in the purchasers rights under the contract or in the property have the right for a period ending March 18, 2016, (60 days following the recording of the declaration of forfeiture) to commence a court action by filing AND serving a Summons and Complaint to set aside the forfeiture if the seller did not have the right to forfeit the contract or failed to comply with RCW 61.30 et seq. in any material respect.
