Businesses gird to fight smoking ban

More than 30 Pierce County businesses are looking to seek an injunction against the recent smoking ban by the Tacoma- Pierce County Board of Health.

The group says the county cannot overrule the statewide law that makes certain businesses exempt from smoking bans – restaurants, bars, bowling alleys and casinos – all of which are included in the county’s new rule.
However, Attorney General Christine Gregoire said a 1998 opinion from her office calling local smoking bans illegal wasn’t definitive.

The state restaurant association has said it may file a lawsuit against the county and was still considering that option.
